Spider-Man in movies is owned by Sony so he won't be in the next Avengers, which is confirmed but it won't be out until after Thor 2 (November 2013), Iron Man 3 (May 2013), and Captain America 2 (Summer 2014).

The earliest possible for an Avengers sequel is around 2015. Between then, around 6 Marvel Avenger-related movies are releasing, a Hulk movie is possible and a Black Panther one too. Spider-Man will not be in the Avengers, but The Amazing Spider-Man 2 is confirmed with a possible 3rd one. In the newest Avengers, it's likely that Wasp, Giant/Ant Man, and the Black Panther will join.
